At approximately 11:20 p.m., Atwater PD Officer Dasilva was dispatched to the 400 block of Alder Ct. to conduct a welfare check following a disconnected phone call between the victim and her suspect.

Upon arrival, a verbal dispute was overheard in the home.  The suspect was overheard saying something to the effect of “Five bullets will take care of the problem”.  Upon contacting the suspect at the door, he refused to exit the home.  The victim met officers at the door after the suspect walked away and warned us that he was armed with a firearm.  At that time the victim exited the residence; however our repeated commands for the suspect to exit were met with negative results.

While outside of the residence, the suspect exited the home into the back yard yelling at officers that he had a high powered rifle with a 3 power scope.  He said he had officers in his sights and wanted them to depart his property.

The victim stated the suspect was despondent as a result of multiple issues due to a medical diagnosis and other problems he was taking medications for.

A perimeter was maintained with assistance from California Highway Patrol and Merced Sheriff’s Office.

The victim stated she was choked by the suspect and threatened to be killed prior to officers arrival. An emergency protective order was obtained; however has NOT been served on the suspect yet.

No weapons were observed by law enforcement and the suspect refused communication.  Atwater PD issued a wanted persons be on the lookout on the suspect for domestic violence and officer safety.  The victim was transported to Mercy hospital for treatment and law enforcement cleared the area.
